QuenLin Entertainment (Ishvar Warriors) Terms of Service

By registering and/or making an account with any QuenLin Entertainment product you are also agreeing to comply with the following Terms of Service (TOS). The TOS covers QuenLin Entertainment Privacy Policy as well as the rules and guidelines for playing any/all of the games and communities affiliated with the company. Take notice that this is a binding contract between yourself and QuenLin Entertainment. Furthermore, if you do not agree with the TOS, DO NOT make or create an account of any kind with any affiliated sites with QuenLin Entertainment.

By registering an account or signing onto any of the community sites you are subject to the TOS without exception. By doing so it signifies your acceptance of and full agreement for the TOS. You also agree to have the legal capacity to make this agreement.

By logging into a site affiliated with QuenLin Entertainment you are subject at any/all times to the following TOS and Privacy Policy. All content, including but not limited to, accounts created, profiles, forum posts, mail, game activities, are monitored with reference to the TOS. This includes, proper in-game conduct and communications. The TOS may edited/changed as time goes by. It is each individual players responsibility to maintain the guidelines.

It is recommended that all users review the TOS periodically since the game is on an evolving community. QuenLin Entertainment reserves the right, at its sole and absolute discretion to revise, amend, change, add to, delete, or update the TOS, effective with or without prior notice. If you find you do not agree to these TOS or the revised/updated TOS, or simply you no longer comply with the TOS, you are required to terminate your account with QuenLin Entertainment immediately and cancel any/all agreements. If you chose to continue to log into any game/community affiliated with QuenLin Entertainment after the revised/updated TOS, you are again agreeing to your acceptance of any and all changes. QuenLin Entertainment may change, modify, suspend, or discontinue any aspect of the game and/or community at any time. QuenLin Entertainment may also apply limits on any feature and/or restrict access to any/all parts of the games without notice or liability.

To play any game by QuenLin Entertainment, you must register and create a valid account. In so doing you agree the account, including the log in name AND user name, is and will remain the property of QuenLin Entertainment . You may not use any name that violates any third party's trademark rights, copyrights, or any other proprietary right, or any name Staff deems is vulgar or offensive. QuenLin Entertainment and Staff (further referred as Game staff), has the right to delete any user-name they deem vulgar or offensive., or to ask that you change your name. It is up to you to choose, and pay for any/all services, and/or equipment needed for you to access the Internet. To play any games by QuenLin Entertainment, you need access to the Internet.

I.) Conduct/Behavior Guidelines

All games and communities affiliated with QuenLin Entertainment are governed by certain rules. The rules are monitored and maintained by the designated staff for the site exclusively and must be adhered to by all players. It is every players responsibility to know, understand and abide by the guidelines stated here. The following rules are meant to be exhaustive, and Game Staff reserves the right to determine which conduct it considers to be outside of the game and to take any disciplinary measures as is seen fit to and including termination and deletion of your account.

    a.) Mail, Forums, Profiles (Any type of communications) Rules

    Communication in any QuenLin Entertainment game or community, whether with Game Staff or other Users is an integral part of the site. Be it simply by what you put in your profile, your guild page, your name, or your forum posts and/or on site mail. This is here as referred to as "Chat". In the sole and complete discretion of Game Staff, you may not do the following.

        i.) Transmit or post any content or language which is considered to be offensive. Including, without limitation , content or language which is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, sexually explicit, or racially, ethnically or otherwise objectionable. Nor may you use misspelling or an alternative spelling to circumvent the content and language restrictions listed above.

        ii.) In the forums: You may not disrupt the normal flow of the conversations by posting unrelated images, posts, or solicitations and/or advertisements from goods or services outside of the game.

        iii.) Continually sending repeated messages to one player, that is unwelcome. Or repetitively posting the same thing in the forums.

        iv.) DO NOT post or discuss ANY user's personal information in the game. That includes, mail, forums, profiles etc. The only exception is that the user may send their own personal information, but ONLY in mail provided in game. Never anywhere else.

        v.) Harass, threaten, stalk, embarrass or cause distress, unwanted attention or discomfort to any user in the game. (Outside of normal game play killing).

        vi.) Partake in any actions that leads to any player of the game getting 'scammed' out of any item obtained through game play or purchased. (Sole and absolute opinion of Game Staff)

        vii.) Impersonate any real person, including but not limited to, any game staff, nor may you post messages or act as any member of the Game staff.

        viii.) If a person is banned from posting in the forums, you are not permitted to relay messages and/or post messages on the forum for this person. All bans are given to keep said person off the forums, you relaying their messages my incure the same for you.

    b.) Names (User and Guild)

    Each player upon creation will need to pick a unique log in name. On creation this is your User name. We highly recommend you change that to make it more difficult for people to figure out your account info. Guild names are also to be unique. When choosing a name in game whether user name or guild name please use common decency. Game Staff reserves all right to change any name or label even terminate an account if you do any of the following.

        i.) Tying to use another persons name with the full intent of impersonating then or cause harm.

        ii.) Uses any vulgar or offensive, defamatory, obscene, hateful, or racially, ethnically or otherwise objectionable.

        iii.) Related to drugs, sex, alcohol, or criminal activity.

        iv.) That is, or resembles, a trademark or service mark, whether registered or not.

    c.) Game Play Rules

        i.) Exploiting any flaws in game design, or 'program bugs' that enables you to go where otherwise not available, or obtain a competitive edge on other players.

        ii.) Conduct that is prohibited elsewhere in the 'Rules'.

II.) Age and Eligibility Requirements

QuenLin Entertainment games are generally not intended for children under the age of 13. We do not target or advertise for children under 13 nor do we knowingly collect personally identifiable information from them.

In accordance with the Childrens Online Privacy Protection Act of 2000, anyone under the age of 13 may not have personal information collected on them. Thus they are prohibited from registering an account on QuenLin Entertainment games and sites. We do not knowing accept any applications transactions or other submissions from anyone under 13. If we learn that anyone under 13 is attempting to play Game Staff will terminate all accounts tied to the person(s).

If you are over 13 but still considered a minor by law of your relevant state, please review the TOS with your Parent(s) or legal guardian(s) to ensure that you understand them and can comply. We recommend that parents join on the experience with their children to spend time with them on the gaming experience. Not only to monitor their children and spend time with them, but also to get to know the QuenLin Entertainment rules and regulations. To ensure your child is in a good environment.

However, as we are aware that there is a constant flow of people in the QuenLin Entertainment gaming sites, we also know that some things do get posted before we can catch them and remove them. Such as language, or other material that is inappropriate for children or offensive to users of any age. As such, it is highly recommended that parents monitor their younger children in case they come across something inappropriate.

III.) Creation of Accounts

Before creation of any account, all players agree to these TOS. So all members agree to being above the age of 13. Any minor above the age of 13 has had their parents go over the TOS with them. On registration you are asked to create a unique log in for your accounts. We highly recommend that after you first log in you change your name via the Edit Account page. Keeping in mind and following the name and content guidelines.

QuenLin Entertainment and Game Staff can and does issue warnings and temporary suspensions for violations of any of the guidelines set here in the TOS. The outcome is determined by the violation and number of previous infractions. However, accounts can be banned temporarily or permanent without any warning.

IV.) Multiple Accounts

Ishvar Warriors staff would like for any one person to get the full enjoyment and playability out of the game. That is why we decided to let players have up to 4 accounts. These accounts may be of any class, and does not have to be one account of every class. If you want to make 4 different fighters, make 4 fighters. Anything over 4 can/will be determined as attempting to cheat the system. The game staff will then take liberties to remove any of the accounts from the game until you are down to 4.

This does not include just making 3 level one accounts and just feeding one account items, platinum and money you make daily. This is and will be frowned upon as unfair. We would like to specify that if you have multiple accounts you may trade between the accounts anything of use. Albeit, we also like to ensure you are playing all accounts actively. Please, do not attempt to abuse the trust of the game staff, if you do appropriate actions will be taken.

These rules also apply to anyone just logging in and making accounts to trade to other players. If you are not actively playing each account doing the transactions you are only permitted one account in which you may do the transactions.

V.) Ownership of Content and Selling of the Account or Virtual Items

QuenLin Entertainment does not recognize the transfer of accounts. You can not purchase, sell, gift, or trade any accounts OR offer to trade, sell, or gift any account. Any such attempt shall be null and void. QuenLin Entertainment owns, has licensed, or simply has all rights to any accounts and all game currency and/or anything in the game. We do not recognize any transactions made outside of the game. Basically, we do not allow the selling of any 'virtual asset' for 'Real World' Money except from the game shop alone.

You agree that Quenlin Entertainment has all rights to any/all game assets and accounts. Also has the right to modify any said virtual assets as desired. Henceforth you agree to never assert or bring claim against Quenlin Entertainment or any of it's staff/employees based on:

        i.) Ownership of any virtual asset.

        ii.) Any asset that is changed or modified.

        iii.) The cost or expired sale on any virtual asset's cost

        iv.) Claim to amount of time playing any QuenLin Entertainment Game

VI.) Account Security

For optimal security do not ever give out any of your information. Passwords, log in, security words to anyone outside of the Game Staff. If at all possible, Game Staff will never ask you your login, email, or password.

For you security we have implemented a 'security word' system. Make it challenging, make it something only you know and won't forget. There will be a 'hint' we will give you, just be sure you make it challenging to figure it out. Do not give complete strangers your email address. It has been proven that most of the time you get hacked because of your lack of security, and by close friends. They go in get your 'Security Question' And answer it correctly. Then they have full access to anything of yours. We can not tell you how to do anything, but we can say if we have a lot of issues with one account being lost or changing hands, we will lock said account down.

Furthermore, use common sense, and trust NO ONE. We do all we can on our end, your account security is your responsibility.

VII.)Privacy Policy

Ishvar Warriors and staff recognizes a players rights to privacy. Identity of accounts, filed complaints, discussions with support, and even any reasons an action is taken against you in the game. Everything listed is and will be treated as confidential and will not be discussed by any staff except between other staff. That includes if asked in a forum, a mail, messenger or other means of communication, inside game and out. Under no circumstances will staff discuss any player information with anyone.

Also in this regard, if one of the staff is accused of any of the above actions, the matter will be reviewed. If found to be doing any of the things listed said staff account would be removed from staff AND game with out notice.

Another item covered in the games privacy policy is a players purchase record. Anything bought in the game by any user is between them and QuenLin Entertainment. No other staff member should be aware of these transactions and amounts.

In this regard, if you decide to go to the forums and the public with only half truths and defamitory remarks about the staff and decisions made by the game; Ishvar will, and has all right to show the full context of anything you are hiding to display full context of the situation.

We hope to provide a game where people can remain inconspicuous if they want to, be it from another game or one of their alternate accounts on IW.

VIII.) Mature Content

QuenLin Entertainment does not condone mature content on their site(s). However, they are not responsible for everything that is put onto the site by other members. If any mature content is noticed by any member of Game Staff, the content will be removed and proper actions taken to adjust/fix the situation. Again, QuenLin Entertainment can not, and will not be held responsible for everything that is posted on the site.

IX.) Server Downtime

QuenLin Entertainment tries to maintain minimal downtime. However sometimes things happen that are out of our control. If the server goes down outside of the routine maintenance then we will work to get the game up and running as fast as we can. If for some reason we are down for an extended period of time, QuenLin Entertainment will do all we can to compensate everyone for any lost time on items, extenders and possibly just a small gift to all players as a thank you for waiting.

We at QuenLin Entertainment understand the frustration of not being able to get onto your site and hope to make this gaming experience as fun as possible with little to no disruptions.

X.) Service updates and/or Changes

QuenLin Entertainment reserves all rights to make changes to any/all policies, features of the site, services, availability data or content with or without any notice at all. However, most changes should be announced prior to or following.

XI.) Game Rules

ALL players on the the site must adhere to these guidelines at all times with no exceptions when interacting with anyone on any one of QuenLin Entertainment sites. As well as these rules you must also try and abide by basic rules of etiquette, common courtesy, and common sense when communicating on site. Any law that violates offline, real world community is also a violation of Terms, we do not tolerate any illegal conduct and will help law enforcement if such behavior entitles.

Since this game is primarily run by English speaking people we like to request that all communications in the game remain English speaking so that we can ensure the rules are abided by. Also, these basic rule are written to try and make the gaming experience from QuenLin Entertainment enjoyable for all cultures and the different background playing around the world.

        i.) All content posted on the site, forum, mails, profiles, guilds, tags, names and so on, must meet the TOS requirements and the Name guidelines a fore mentioned.

        ii.) You may not impersonate any member of staff, or other players in any fashion.

        iii.) No threatening, abusive, obscene, harmful, defamatory, vulgar, harassing, hateful, racial, or objective language toward other players is permitted. English is the primary language of the forums we recommend you use it.

        iv.) By Game Staff standards, you may not harass or cause any distress to other players. No black listing in the forums. (DO NOT, make threads to, or simply say bad things about other players) It is not permitted.

        v.) You may not join or create any organization/guild in game that is hate oriented or segregated. Example- Religion base, culture base, race based, etc. (Game based is allowed, ex. Warrior Guild)

        vi.) You may not use any sexually explicit language that is inappropriate, or depicts sexual acts including, language of violent, threatening manner towards another player or group of people.

        vii.) You may not market any 'Virtual Assets' for 'Real World' currency in any way. Including accounts.

        viii.) You are not allowed to 'encourage' others to violate the TOS or break real laws.

        ix.) You are not allowed to violate any Real world state, local, national, international laws or regulations on the game.

        x.) Violating the intellectual property rights of a third party is prohibited. Uploading, or communicating copyrighted material without any permission through the site.

        xi.) You are only permitted to use the site as a community and/or game. No other activities.

        xii.) You aren't allowed to give false information to QuenLin Entertainment employees. Such as billing info, emails, age, name etc.

        xiii.) If asked to do something by any member of Game Staff you will do what is requested to the best of your ability. As long as it isn't illegal.

        xiv.) You are not permitted to transfer any pirated software through our sites.

        xv.) You are not allowed to hack, or interfere with any information being transferred to/from the servers the game is on or the site itself.

        xvi.) You may not relay any players real world information in any fashion, including your own within the site. You may not give your password or log in with any player. If you do you will not hold QuenLin Entertainment responsible for loss or damages of account.

        xvii.) Exploiting any bug or glitch in the game is prohibited. If found you will point it out to one of the design team (Game Staff) As soon as you notice it. You are not allowed to communicate the existence of said bug with any other player only staff. Failure to do so can result in loss of account.

        xviii.) If your account is doing any action you must the one clicking the buttons. Any applications used to run your game while you are away is prohibited.

        xix.) You may not post a web address or URL to any outside sites linked to explicit, illegal, sexual content or anything that can disrupt another users computer/network.

        xx.) You may not abuse the help system, support or petitioning system. After 1-2 replies if it hasn't changed, it won't. Continuing to complain will lead to farther actions.

        xxi.) You may not do anything that disrupts other players from playing or that disrupts the server the game is running on.

        xxii.) You may not accept any altered item that you know has been altered or isn't any form of original item. We reserve all rights to confiscate any/all said items.

XII.) Payment methods/Virtual Assets, Refunds and Returns

All payments for Virtual Assets are done by Pay-Pal and/or MoneyBookers. Currently these are the ways to purchase items unless someone sells them on the in-game market for other game assets. There aren't any refunds and/or returns, any refunds or pull/canceling of fund can/will result in disciplinary actions. Most likely denied access from the site permanently

If found violating the ToS, QuenLin Entertainment and staff are able to deny you access to the game for any length of time without any compensations for days lost on Valiant Warrior status, or Boost days.

XIII.) Game Disciplinary Guide

Any and all communities should have a standard system for how things are done. Most places do not give you the courtesy of a written guideline as to how things are handled. Here you will get a small section just for game discipline. Keep in mind, any all actions taken are based on severity of the problem which is judged by Game Staff. There is no guarantee that these guidelines will be how your case is handled.

QuenLin Entertainment would like to treat every occurrence fairly and openly. So majority of the problems will result in a 'Timed Ban'. Or temporarily frozen state of the account. In any instance you are frozen you are capable to plea your case with Game Staff by sending an email to game support. If you are found to have been wrongly frozen then we will compensate you for anything loss with our deepest apologies. However, once you are frozen once for a set amount of days, the next time you are frozen has to be greater than the previous. It is predetermined and permanently documented. So even if it's 2 years later you will have to be frozen longer than the previous.

QuenLin Entertainment also will not allow any person(s) who play the game to staff. There will be too much that staff can see and do to be allowed to play the game. To help decrease controversy this is done.

Mail Bans, and Forum Bans are also handled the same way as frozen accounts, they will not be allowed to ban you less than a previous banning. So the more times you are banned, the longer you get banned.

There is one other type of banning Game Staff will hope never has to be used. If a person proves to be problematic and constantly posts bad stuff, and harasses people in mail, and just does all the torment they can in any way possible, Game Staff will be able to put on a FULL communications ban. This ban will block you from changing your profile, your name, sending mail, changing your guild page, basically ALL communications in the game is blocked from you. All you will have access to is playing. If you receive this ban, there isn't a time limit. Only a staff member can remove it.

XIV.) Access Denial

At the sole discretion of Game Staff you may lose access to any and/or all of the game/communities features. If any features are lost, you will generally have a brief notice on your page as to why you lost said service. Example, if your account is frozen, you will be directed to a 'frozen' page that will give you a brief reason as given by Game Staff. Same thing applies for forum bans and Mail bans. If at any time you believe you are wrongfully disciplined message our support JUST ONCE. We will get back to you. If for any reason you do not like your answer, we recommend that you shrug it off and go with it. Continue to harass the support can lead to full account removal.

XV.) Disclaimers

The game and the service is provided on an 'as is' 'as available' basis, and QuenLin Entertainment does not warrant that the game or service will be uninterrupted or error-free.

XVI.) Limitation of Liability

QuenLin Entertainment can not be held liable for any loss of time spent playing our games and not with families, bathing, cleaning or otherwise things you should be doing. Including but not limited to sleep, eating, exercising etc. We highly recommend that you get out of the house as much as possible and enjoy the fresh air when you can.

And in no event shall QuenLin Entertainment be liable for any indirect, incidental, special, exemplary, punitive, liquidated, or other consequential damages, whether under contract, tort (including negligence), strict liability or any other theory of liability, arising from your use of the game or the service. The foregoing limitations shall apply to the maximum extent permitted by law, even if any remedy fails of its essential purpose. At no time will QuenLin Entertainment's aggregate liability, whether arising in contract, tort, strict liability or otherwise, exceed the total amount you paid to Quenlin Entertainment during the six(6) months prior to the date the claim arose.

XVII.) Third Party Sites and Advertising

Clicking any hyperlink on a QuenLin Entertainment site that does not share the sites URL may direct you away from the site. Quenlin Entertainment only does this from the Voting pages. Anything/Everything else can is posted by another player and may be malicious. QuenLin Entertainment is not responsible for any URLs posted in the forums, mails, etc. We strongly recommend that you use standard precaution when clicking third party URLs. And also to remind you that the purchase of any 'Virtual Assets' from a third party will result in possible account closure.

QuenLin Entertainment is not responsible for anything advertised by any third party on our sites. Likewise we are not responsible for any errors or omissions cause by third party advertisements as they are not our own.

XVIII.) Indemnification

You hereby agree to defend and hold harmless QuenLin Entertainment, it's affiliates, and respective officers, directors, employees, agents, licensors, representatives and third party providers from and against any claim, liability, injury, damage, loss or expense (Including reasonable attorney fees) incurred as a result , arising from, or relating to your use of the game and/or the TOS.

XIX.) Miscellaneous

QuenLin Entertainment reserves all right not expressly granted herein. Sub licensing, renting, selling or transferring the rights and obligations granted to you in this agreement is strictly prohibited and any attempted transfer is hereby null and void. If for any reason a provision in this agreement is unenforceable, such provision shall be deemed sever-able from this agreement and shall not affect the validity and enforceability of any remaining provisions.
